RLLS’ Bankruptcy and Creditors’ Rights Practice Group represents the interests of borrowers and secured and unsecured creditors primarily in out-of-court workouts and Chapter 11 bankruptcy proceedings. We also represent creditors committees and parties having contracts, leases or other business dealings with bankruptcy estates.  Our group assists clients in anticipating and protecting against the consequences of possible future bankruptcies.Group members have broad experience representing both creditors and debtors in a wide variety of industry sectors, including construction, intellectual property, manufacturing, real estate and retail. Some examples of recent matters handled by the firm include:

  • Representing a senior secured creditor in connection with the pre-bankruptcy negotiation with a defaulting borrower, and the resulting bankruptcy sale of substantial intellectual and other property interests of the borrower
  • Representing a minority shareholder in a bankruptcy involving the sale of international real estate and other foreign assets
  • Representing a large unsecured creditor in the Chapter 11 bankruptcy of a construction company
  • Representing a construction company with $200 million dollars in annual revenue in an out-of-court restructuring
